(٤٠٢٨) وما أقَرَّ بقَبْضِه في مَرَضِه فهو كالدَّيْنِ يُقِرُّ بقَبْضِه في صِحَّتِه.

(٤٠٢٩) وإذا وَضَعَ عنه دنانيرَ وعليه دراهمُ، أو شَيْئًا وعليه غَيْرُه .. لم يَجُزْ.

(٤٠٣٠) ولو قال: قد اسْتَوْفَيْتَ آخِرَ كِتابَتِكَ إن شاء اللهُ، أو شاءَ فلانٌ .. لم يَجُزْ؛ لأنّه اسْتِثْناءٌ.
