(٣٠٧٩) قال الشافعي: ولو خَرَقَ السَّفِينَةَ فغَرِقَ أهْلُها .. ضَمِنَ ما فيها، وضَمِنَ دِياتِ رُكْبانِها عاقِلَتُه، وسَواءٌ مَنْ خَرَقَ ذلك منها.
