الِاعْتِرَاضُ الرَّابِعَ عَشَرَ: اخْتِلَافُ حُكْمَيِ الْأَصْلِ وَالْفَرْعِ

قِيلَ: إِنَّهُ قَادِحٌ؛ لِأَنَّ شَرْطَ الْقِيَاسِ مُمَاثَلَةُ الفرع للأصل في علته وحكمه، فإن اخْتَلَفَ الْحُكْمُ لَمْ تَتَحَقَّقِ الْمُسَاوَاةُ، وَذَلِكَ كَإِثْبَاتِ الْوِلَايَةِ عَلَى الصَّغِيرَةِ فِي نِكَاحِهَا، قِيَاسًا عَلَى إِثْبَاتِهَا فِي مَالِهَا.
